Pune has a large population of couples who moved here after marriage for work, education or a new life together. The place where your marriage was solemnised is only one of the jurisdictional factors under Section 19 of the Hindu Marriage Act. Depending on the facts, jurisdiction can also arise from where the spouses last resided together and, in the circumstances provided by law, where the wife resides.

If you were married in another state, do not assume that you must return there to file. Which Law Applies to Your Marriage?

The mutual consent route depends on the law under which your marriage is governed. We confirm the applicable statute before drafting rather than assuming it from your current address or religion alone.

Hindu, Buddhist, Jain or Sikh Marriage

Section 13B of the Hindu Marriage Act, 1955 provides the mutual consent divorce route where its requirements are satisfied, including the statutory separation requirement.

Christian Marriage

For marriages governed by the Indian Divorce Act, the mutual consent route is under Section 10A of the Indian Divorce Act, 1869, which has a different statutory separation requirement.

Marriage Under the Special Marriage Act

If your marriage was solemnised under the Special Marriage Act, the mutual consent route is provided by Section 28 of the Special Marriage Act, 1954. An interfaith couple is not automatically governed by this Act merely because the spouses follow different religions, how the marriage was solemnised matters.

Cooling-Off Period or Waiver Request

The statutory six-month period between the two motions may, in appropriate circumstances, be the subject of a waiver request. Courts have recognised in Amardeep Singh v. Harveen Kaur (2017) 8 SCC 746 that this can be waived where the couple has not been living as husband and wife for over one year, but waiver is not automatic and the court decides.

Second Motion & Divorce Decree

At the Second Motion, the spouses confirm that they continue to consent to the divorce and the court considers the matter in accordance with the applicable law. Once the decree is passed, the marriage is dissolved from the date of the decree.

ESOPs, Bonuses & Variable Compensation

Many Pune professionals work in technology, engineering, research and other sectors where compensation can include ESOPs, RSUs, performance bonuses or other variable components. Where these are relevant to the settlement, the MoU should address the agreed treatment clearly rather than leaving the issue to assumption.

Joint Flat, Home Loan or Other Property

If both spouses own a home or have contributed to a property with an outstanding loan, the settlement should deal with the property and the associated liability together. A clear agreement can avoid leaving the question of future EMI or ownership unresolved after the decree.

If One Spouse Is Working or Living Abroad

A spouse being outside India does not by itself prevent a mutual divorce proceeding in Pune where the court otherwise has jurisdiction. The practical question is how that spouse will participate in the proceedings and complete any documents the court requires.

Physical appearance is generally expected for the court process, but in an appropriate case the court may permit an alternative arrangement, including video conferencing. Privacy Matters When You Are Ending a Marriage

Family Court law provides for proceedings to be held in camera when the court so directs, and requires this when either party so desires. That is different from saying only four people can ever be present, court staff, counsellors or other persons may be involved where the court's procedure requires it. Not automatically. The applicable court depends on the jurisdictional grounds available to your particular case. Your current address is relevant, but it is not the only factor we review before filing.

We married in another state and now live in Pune. Can we file here?

Can the six-month cooling-off period be waived?

In appropriate circumstances, a waiver request can be made. In Amardeep Singh v. Harveen Kaur (2017) 8 SCC 746, the Supreme Court recognised that the six-month period can be waived where the couple has not been living as husband and wife for over one year, mediation has failed, and the settlement is fully agreed. Waiver is not automatic and the court decides the request.

Do both spouses have to appear in court?

What happens if one spouse withdraws consent?

Mutual consent must continue until the divorce is granted. If either spouse withdraws consent before the decree is passed, the mutual consent petition cannot proceed on that basis, and other legal options may need to be considered.

We have ESOPs and a joint home loan. How are these handled?

Where relevant, these are addressed expressly in the settlement MoU, recording what both spouses have agreed about the equity, the property and the outstanding liability, rather than leaving important financial questions unclear.

Can a spouse living abroad participate in a Pune mutual divorce?

Yes, living abroad does not by itself prevent a case where Pune has jurisdiction. The court may require personal participation or may permit an alternative arrangement in an appropriate case, subject to its approval.
